VICTORIA – An independent panel has been appointed to conduct a review and provide recommendations for potential amendments.
B.C. Minister of Labour Harry Bains appointed the three-member panel, which will be chaired by former B.C. Labour Relations Board associate chair Michael Fleming.
Other members include labour and employment lawyers Sandra Banister and Lindsie Thomson. Banister represents worker and union interests and Thomson is sitting on behalf of employer interests.
The panel will consult interest groups and Indigenous parties across the province before reporting back to the minister by May 31, with a report and recommendations for possible Labour Relations Code amendments.
The panel will also consider relevant developments in other Canadian jurisdictions to ensure B.C.’s labour laws are consistent with labour rights and protections experienced by other Canadians, a B.C. government release said.
The Labour Relations Code defines relationships between provincially regulated employers, workers and trade unions, and the rules for issues related to collective bargaining.
The provincial minister of labour is required to appoint a committee of special advisers every five years to undertake an independent Labour Relations Code review and make recommendations, the release stated. The last comprehensive review took place in 2018, which resulted in several substantive amendments made in 2019 and 2022.
